User Registration and Privacy Protection Service Agreement

JohnCloud Group Limited provides services to you through the following terms. You should read and abide by the “User Registration and Privacy Protection Service Agreement” (hereinafter referred to as “this Agreement”), which is a legal agreement between you and JohnCloud Group Limited. Before using the services provided by JohnCloud Group Limited, please carefully read and fully understand the contents of each clause, especially those related to privacy protection, user information, disclaimers, and jurisdiction and applicable law. Unless you have read and accepted all the terms of this Agreement, you are not authorized to use the services provided by JohnCloud Group Limited. Your use of JohnCloud Group Limited’s services will be deemed as your acceptance of this Agreement, including any amendments made by JohnCloud Group Limited to these service terms at any time.

Section 1 Service Description

The specific service content of JohnCloud Group Limited is provided based on the actual circumstances, such as photo upload functions, invitation sharing, U-share packages, membership, etc. JohnCloud Group Limited reserves the right to change, interrupt, or terminate some network services. JohnCloud Group Limited reserves the right to adjust the types and forms of services provided on the JohnCloud Group Limited platform at any time based on actual circumstances. JohnCloud Group Limited is not responsible for any losses caused to users due to business adjustments. JohnCloud Group Limited only provides related services; users must bear the costs for the equipment related to these services (such as computers, modems, and other devices related to internet access) and the associated fees (such as telephone fees and internet fees for internet access).

Section 2. Privacy Protection

  1. Users may need to fill in or submit some necessary information during the process of registering an account or using the service, as required by laws, regulations, and normative documents (hereinafter referred to as “laws and regulations”). If the information provided by the user is incomplete or does not comply with the requirements of laws and regulations, the user may not be able to use the service or may face restrictions during its use.
  2. Personal private information refers to information that involves a user’s personal identity or personal privacy, such as the user’s real name, ID number, mobile phone number, mobile device identification code, IP address, user chat records. Non-personal private information refers to the basic records of the user’s operational status and usage habits of the service, which are clearly and objectively reflected on the JohnCloud Group Limited server, other ordinary information outside the scope of personal private information, and the above-mentioned private information that the user agrees to disclose.
  3. Respecting the privacy of users’ personal private information is a consistent policy of JohnCloud Group Limited, which will take technical and other necessary measures to ensure the security of users’ personal private information and prevent it from being leaked, damaged, or lost during the service. In the event of any of the aforementioned situations or if JohnCloud Group Limited discovers the possibility of such situations, remedial measures will be promptly taken.
  4. JohnCloud Group Limited will not disclose or reveal users’ personal private information to any third party without user consent, except in the following specific circumstances:
    (1) Providing users’ personal private information in accordance with laws and regulations or as directed by competent authorities;
    (2) Any personal information leakage resulting from the user disclosing their password to others or sharing their registered account and password with others, or any leakage not caused by JohnCloud Group Limited;
    (3) Users choosing to disclose their personal information to third parties;
    (4) Users agreeing with JohnCloud Group Limited and its partners on the use and disclosure of users’ personal information to partners;
    (5) Any personal private information leaked due to hacker attacks, computer virus invasions, or other force majeure events;
    (6) Other circumstances as stipulated in this Agreement.
  5. The user agrees that JohnCloud Group Limited may use the user’s personal information in the following circumstances:
    (1) Sending important notices to the user in a timely manner, such as software updates and changes to the terms of this Agreement;
    (2) Conducting internal audits, data analysis, and research within JohnCloud Group Limited to improve its products, services, and communication with users;
    (3) Disclosing the user’s personal information, managing, reviewing user information, and taking necessary handling measures according to the stipulations in this Agreement;
    (4) Other matters as prescribed by applicable laws and regulations.
    Apart from the above-mentioned matters, JohnCloud Group Limited will not use users’ personal private information for any other purposes without user consent.
  6. To improve JohnCloud Group Limited’s technology and services and provide users with a better service experience, JohnCloud Group Limited may collect and use or provide users’ non-personal private information to third parties.

Section 3. User Information Collection

When JohnCloud Group Limited provides services, it may collect, store, and use the following information about you. If you do not provide relevant information, you may not be able to register as a user of JohnCloud Group Limited or enjoy certain services provided by JohnCloud Group Limited, or achieve the intended results of the relevant services.

  1. Information You Provide to JohnCloud Group Limited
    When you register for a JohnCloud Group Limited account and/or submit information while using the services provided by JohnCloud Group Limited, including but not limited to your phone number, username, and other information.
  2. Information Collected During Your Use of the Services
    To provide and optimize the services you need, JohnCloud Group Limited will collect relevant information pertaining to your use of the services. This information includes:
    (1) Information automatically received and recorded by JohnCloud Group Limited from your browser and computer when you use the JohnCloud Group Limited platform services, including but not limited to your IP address, actual location information, browser type, language used, access date and time, software and hardware characteristic information, and the page records you need, etc. If you download or use client software from JohnCloud Group Limited or its affiliated companies, or access mobile webpages to use JohnCloud Group Limited platform services, JohnCloud Group Limited may read information related to your location and mobile device, including but not limited to device model, device identifier, operating system, resolution, telecom operator, etc.
    (2) Please do not voluntarily provide your sensitive personal information (e.g., race, religion, political stance, personal health and medical information, sexual orientation, etc.) to JohnCloud Group Limited while using the JohnCloud Group Limited platform services; otherwise, JohnCloud Group Limited does not guarantee the possibility of accidental collection.
    (3) When using specialized services provided by the JohnCloud Group Limited platform, JohnCloud Group Limited will collect other necessary information as required by the specialized services. JohnCloud Group Limited will strictly collect information in accordance with legal and regulatory requirements. You should ensure the authenticity of the identity information you fill in or submit; otherwise, JohnCloud Group Limited may choose to refuse to provide you with the relevant services.
    (4) In addition to the above-mentioned information, JohnCloud Group Limited may also collect other information for the reasonable need to provide and improve services, including information provided by you when you contact the JohnCloud Group Limited customer service team, responses sent by you to JohnCloud Group Limited during surveys, and related information collected when you interact with JohnCloud Group Limited’s affiliates and partners. At the same time, to improve the security of the services provided by the JohnCloud Group Limited platform and more accurately prevent phishing website fraud and trojan viruses, JohnCloud Group Limited may judge the risk of your account by understanding some of your internet usage habits and commonly used software information, and may record some URLs deemed risky by JohnCloud Group Limited.
  3. Information from Third Parties
    To provide you with better, more personalized services, or to jointly provide services to you, or to prevent internet fraud, JohnCloud Group Limited’s affiliates and partners may share your personal information with JohnCloud Group Limited based on legal provisions or agreements with you, or with your consent.

You understand and agree that the following information does not apply to this privacy protection clause:
(1) Keyword information you enter when using the JohnCloud Group Limited platform’s internal search services;
(2) Data collected by JohnCloud Group Limited during evaluations made on the JohnCloud Group Limited platform, including but not limited to username, product name, and evaluation details, when you do not choose the “anonymous evaluation” function;
(3) Credit evaluations, behaviors violating laws or JohnCloud Group Limited rules, and measures taken by JohnCloud Group Limited against you;
(4) Enterprise names and related industrial and commercial registration information required to be publicly disclosed by laws and regulations, and information of individual business operators.

You acknowledge and agree that JohnCloud Group Limited may cooperate with third parties to provide relevant network services to users. In such cases, if the corresponding entity under JohnCloud Group Limited has signed appropriate confidentiality clauses with such third parties, JohnCloud Group Limited has the right to provide user registration information and other materials to the third parties and require the third parties to handle the above-mentioned information in accordance with JohnCloud Group Limited’s privacy protection clauses and any other relevant confidentiality and security measures. Furthermore, without disclosing individual user privacy data, JohnCloud Group Limited has the right to analyze and commercially utilize the entire user database. JohnCloud Group Limited may also conduct statistical analysis of service usage. Additionally, JohnCloud Group Limited may share these statistical information with the public to show the overall usage trends of JohnCloud Group Limited services. These statistical information do not include any of your identification information.

Section 4: Purpose and Methods of Information Usage

Since the collection of your information is aimed at providing you with services and improving service quality, JohnCloud Group Limited will use your information for the following purposes to achieve this:

To provide you with various services you use and to maintain and improve these services.

JohnCloud Group Limited may use the contact information in your personal information to communicate with you, such as notifying you of updates related to your account, security updates, product and service information. To serve you better, please promptly check the related information sent by JohnCloud Group Limited.

To recommend content that you might be interested in, including but not limited to personalized third-party promotional information displayed through the system or sharing your information with JohnCloud Group Limited’s partners according to these terms so they can send you information about their products and services. If you are not interested in the content recommended by JohnCloud Group Limited, please promptly respond to cancel the notification.

JohnCloud Group Limited may use your personal information to prevent, detect, and investigate fraud, security threats, illegal activities, or violations of the agreements, policies, or rules of JohnCloud Group Limited or its affiliates, in order to protect you, other JohnCloud Group Limited users, or the legitimate rights and interests of JohnCloud Group Limited or its affiliates.

JohnCloud Group Limited may combine personal information from one service with information from other services to provide you with more personalized services, such as expanding your social circle by using, sharing, or disclosing such information.

JohnCloud Group Limited will not provide, sell, rent, share, or trade your personal information to any unrelated third party unless we have your prior consent, or such third party and JohnCloud Group Limited (and its affiliates) provide you with services either independently or jointly, and such third party will be prohibited from accessing all subsequent information after the service ends, including any information they were able to access previously.

You acknowledge and agree that JohnCloud Group Limited may provide links through advertisements or other means to allow you to access third-party services or websites. When you use such third-party services, you are subject to the terms of service and privacy terms of that third party, and you need to carefully read their terms. This agreement only applies to information collected by JohnCloud Group Limited’s servers and does not apply to services provided by third parties or third-party information usage rules. JohnCloud Group Limited is not responsible for any use of information provided by you by third parties.

Section 5: User Registration

You confirm that when you complete the registration process or actually use JohnCloud Group Limited’s platform services in other ways permitted by JohnCloud Group Limited, you should be a natural person, legal person, or other organization with the corresponding civil capacity. If you do not have the aforementioned qualifications, you and your parents or legal guardian (collectively, “guardians”) should bear all the consequences resulting from this, and JohnCloud Group Limited has the right to cancel your account and seek compensation from you and your guardians.

JohnCloud Group Limited pays great attention to the safety of collecting and using personal information of minors. JohnCloud Group Limited recommends that any minor under the age of 18 should obtain the consent of their guardian before participating in online activities and should comply with the “National Youth Network Civilization Convention.” Guardians should bear the primary responsibility for the risks of minors’ online activities and the protection of the relevant network privacy of minors.

If your user account is found to contain obscene or inappropriate names, the JohnCloud Group Limited platform reserves the right to cancel your user qualification. Please refrain from registering with the real names, titles, stage names, or pseudonyms of party and state leaders or other public figures; do not register with the names of national institutions or other organizations; do not register with uncivilized, unhealthy names, or names containing discriminatory, insulting, or obscene words; do not register with names that can easily cause ambiguity, mislead others, or violate legal regulations. Users are obliged to ensure the security of their accounts and passwords; any losses or damages arising from activities conducted using these accounts and passwords are the sole responsibility of the users, and this platform is not liable.

If users discover that their account has been used without authorization or any other security issues have occurred, they should immediately change their account password and safeguard it properly. If necessary, please notify this platform. The platform is not responsible for any illegal use of accounts resulting from hacking or user negligence.

You understand and agree that once you register a user account, it is deemed that you agree for JohnCloud Group Limited and/or its affiliated companies to send you relevant product and service advertisements, promotional offers, and other marketing information through phone calls, SMS, or emails to the mobile number, email address, etc., provided during registration. If you do not agree to receive such information, you can unsubscribe through customer service or relevant prompts.\

Section 6. User Conduct

Users agree not to use the service for any unlawful or improper activities, including but not limited to the following behaviors:

Publishing or otherwise transmitting information containing any of the following content:

Opposing the fundamental principles established by the constitution;

Endangering national security, leaking state secrets, subverting state power, or undermining national unity;

Damaging the honor and interests of the country;

Inciting ethnic hatred or discrimination, or undermining ethnic unity;

Undermining national religious policies, or promoting cults and feudal superstitions;

Spreading rumors, disrupting social order, or undermining social stability;

Spreading obscene, pornographic, gambling, violent, murder, terroristic content, or inciting crimes;

Insulting or defaming others, or infringing upon the legal rights of others;

Containing false, fraudulent, harmful, threatening, invasive of privacy, harassing, infringing, malicious, vulgar, obscene, or other morally inappropriate content;

Containing content restricted or prohibited by Chinese laws, regulations, rules, ordinances, and any other legally effective norms;

Containing content deemed inappropriate by “JohnCloud Group Limited” for display on “JohnCloud Group Limited”;

Endangering the legal rights of others in any manner;

Impersonating any person or institution, or falsely stating or misrepresenting an affiliation with any person or institution;

Publishing, sending via email, or otherwise transmitting any content that one has no right to transmit under any law, contract, or fiduciary relationship (such as insider information, proprietary and confidential information learned or disclosed as part of employment relationships or under confidentiality agreements);

Publishing or otherwise transmitting content that infringes upon any third party’s copyright, patent rights, trademark rights, trade secrets, or other proprietary rights (hereinafter referred to as “proprietary rights”);

Publishing, sending, or otherwise transmitting any unsolicited or unauthorized advertising materials, promotional information, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;

Publishing, sending, or otherwise transmitting any computer viruses (including but not limited to Trojan horses, worms, time bombs, or cancelbots (hereinafter referred to as “viruses”)) or other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware, or telecommunications equipment;

Interfering with or disrupting the service or servers or networks connected to the service, or violating any rules, procedures, policies, or regulations of networks connected to the service;

Stalking, human flesh searches, or otherwise harassing others;

Intentionally or unintentionally violating any applicable local, national law, and any legally effective rules;

Unauthorized interception, tampering, collection, storing, or deletion of other users’ personal information, in-site messages, or other data, or using such information for any unlawful or improper purpose.

You acknowledge that “JohnCloud Group Limited” does not exercise full control over users’ conduct. When using any content, including relying on the correctness, completeness, or usefulness of such content, you agree to use your own judgment and assume all risks without reliance on “JohnCloud Group Limited.” However, at its sole discretion, “JohnCloud Group Limited” may refuse and delete any content provided through the service that violates the terms or otherwise causes offense to “JohnCloud Group Limited.” You understand and agree that “JohnCloud Group Limited” may, based on legal requirements or good faith belief that disclosure is necessary, preserve or disclose content within the reasonable scope necessary for the following purposes:

Compliance with legal processes;

Enforcement of this user agreement;

Responding to any third-party claims;

Protecting the rights, property, or personal safety of “JohnCloud Group Limited,” its users, and the public;

Any other circumstances that “JohnCloud Group Limited” deems necessary.

Section 7. Intellectual Property

The overall content copyright of “JohnCloud Group Limited” belongs to JohnCloud Group Limited. All products, technology, and programs of “JohnCloud Group Limited” are the intellectual property of “JohnCloud Group Limited” and are not authorized for use here. All design patterns and other patterns, products, and service names of “JohnCloud Group Limited” are trademarks and logos owned by JohnCloud Group Limited. No one may use, copy, or utilize these for other purposes. Without the permission of JohnCloud Group Limited, no organization or individual may copy, disseminate, display, mirror, upload, download, use, or engage in any other acts that infringe upon the intellectual property of JohnCloud Group Limited. Otherwise, JohnCloud Group Limited will pursue related legal responsibilities.

Section 8 Content Ownership

The content provided by “JohnCloud Group Limited” as part of this service may include text, software, sound, images, video, graphics, etc. All such content is protected by copyright, trademark, and other property ownership laws. Users can only use this content after receiving authorization from “JohnCloud Group Limited” or other relevant rights holders; unauthorized reproduction, replication of this content, or creation of derivative products relating to the content is not allowed. “JohnCloud Group Limited” encourages users to fully utilize the “JohnCloud Group Limited” platform to freely post and share their information, but such content must be in the public domain or users must have usage rights to the content. Moreover, users have legal rights, including copyright, over any content they create and post on “JohnCloud Group Limited.” Users should not post any other copyrighted content via “JohnCloud Group Limited.” If “JohnCloud Group Limited” receives a formal copyright complaint, it will remove such content.

Posting Public Information on “JohnCloud Group Limited”:

In this agreement, “public use areas of this service” refers to areas accessible by the general public. Users agree to grant “JohnCloud Group Limited” a global, royalty-free, and non-exclusive right to use content posted in public use areas of this service and any other public use areas of this service, including photos, graphics, or audiovisual materials. “JohnCloud Group Limited” may copy, modify, rewrite, adapt, or publish such content for the specific purpose of displaying, distributing, and promoting the services on which the content is posted. Such usage for photos and graphics is solely for the purpose of posting said photos or graphics on this service. The usage rights remain effective as long as the user keeps the content on the service; if users delete such content from the service, the usage rights terminate upon deletion.

Users agree to grant “JohnCloud Group Limited” a royalty-free, perpetual, irrevocable, non-exclusive, fully sublicensable right to use, reproduce, modify, rewrite, adapt, publish, translate, create derivative works, distribute, perform, and display fully or partially such content in other works in any current or future forms, media, and technologies globally for any other content posted by users in other public use areas of the service.

Section 9. Compliance with Laws

You agree to comply with all provisions of relevant laws and regulations of the United Kingdom and take full responsibility for any activities and their consequences resulting from your use of this service with your password and account. If your actions violate any national laws and regulations, you may be held criminally liable and bear all legal responsibilities. Moreover, if “JohnCloud Group Limited” has reason to believe that any of your actions, including but not limited to your statements and other behaviors, violate or may violate any national laws and regulations, “JohnCloud Group Limited” may terminate the service provided to you at any time without prior notice.

Section 10 Transactions with Advertisers

Any form of communication or business dealings between users and advertisers through this service, or participation in promotional activities, including payment and delivery of related goods or services and any other relevant terms, conditions, guarantees, or representations, are solely between the user and the advertiser. “JohnCloud Group Limited” is not responsible for any loss or damage of any nature incurred by the user resulting from such transactions or advertisers.

Section 11 Disclaimer

The internet is an open platform. Users uploading personal information like photos to the internet may have their content copied, reposted, modified, or used unlawfully by others. Users must be fully aware of such risks. Users explicitly agree to bear all risks arising from their use of the “JohnCloud Group Limited” service; all consequences resulting from the use of the “JohnCloud Group Limited” service will also be borne by the users. JohnCloud Group Limited bears no responsibility for the users. JohnCloud Group Limited does not guarantee that the service will meet users’ requirements, or that the service will be uninterrupted, timely, secure, or error-free. JohnCloud Group Limited is not responsible for any network service interruptions or other defects caused by force majeure or reasons outside of JohnCloud Group Limited’s control. JohnCloud Group Limited is not responsible for the deletion or failure to store information posted by users. JohnCloud Group Limited reserves the right to determine whether a user’s behavior complies with the terms of use agreements of this site. If JohnCloud Group Limited believes a user has violated the agreement’s terms, JohnCloud Group Limited has the right to terminate providing services to the user.

You understand and agree that JohnCloud Group Limited is not liable for any damage, compensation caused by the following situations, including but not limited to lost profits, goodwill, use, data, or other intangible losses:

Use or inability to use the JohnCloud Group Limited platform service;

Unauthorized use of your account or unauthorized alteration of your data by third parties;

Costs or damages incurred by purchasing or obtaining any products, samples, data, information, or conducting similar transactions via the JohnCloud Group Limited platform service;

Your misunderstanding of the JohnCloud Group Limited platform service;

Any other losses related to the platform service caused by reasons not attributable to JohnCloud Group Limited.

JohnCloud Group Limited is exempt from liability for the following force majeure events: normal maintenance of information networks, network connection failures, computer, communication, or other system failures, power failures, strikes, labor disputes, riots, uprisings, disturbances, shortages in productivity or raw materials, fires, floods, storms, explosions, wars, government actions, judicial administrative orders, or inaction by third parties causing service disruptions or delays.

4.. You must strictly adhere to this agreement and other agreements, activity rules, and announcements issued by JohnCloud Group Limited. If your violation of the agreement or rules causes any loss to a third party or JohnCloud Group Limited, you shall bear full responsibility.

Section 12  Supplementary Provisions

The formation, execution, interpretation, and dispute resolution of these user terms shall be governed by the laws of the United Kingdom. If any disputes arise regarding the content or execution of this agreement, users should attempt to resolve them through friendly negotiation with JohnCloud Group Limited; if negotiations fail, any party may file a lawsuit with the People’s Court located in the jurisdiction where “JohnCloud Group Limited” is located. JohnCloud Group Limited’s non-exercise or non-enforcement of any rights or provisions of this service agreement does not constitute a waiver of such rights or provisions. If any clause of this agreement is completely or partially invalid or unenforceable for any reason, the remaining clauses of this agreement shall remain valid and binding. The final interpretation rights for all clauses of this agreement belong to “JohnCloud Group Limited.”
